Entertainment Commission details citations and notices after noise and after-hours complaints

The San Francisco Entertainment Commission on March 21 reviewed an enforcement report covering noise, door‑policy and after‑hours incidents at multiple venues and voted to continue monitoring and pursue administrative remedies where needed.

Deputy Director Azevedo told commissioners the office received 83 complaints since the last hearing, many repeats about the same businesses. Staff described the method used to measure outdoor sound (monitoring a speaker output display and c‑weighted measurements) and said inspectors have been calibrating limits based on equipment changes.

Staff reported eight anonymous 311 complaints about prerecorded patio music at SFMix (4086 Eighteenth Street); an inspection confirmed the venue was compliant after staff and the manager agreed on which speaker display setting to monitor and an inspector confirmed levels were within allowable limits. At White Rabbit (3138 Fillmore Street), inspectors observed the front door propped open during entertainment and, on a later visit, measured sound above the permitted c‑weighted limit; staff issued a citation for operating above sound limits and for the door condition.

Imperial Palace (818 Washington Street), which holds a place-of-entertainment permit, drew repeated enforcement attention after inspectors alleged being denied entry during a Feb. 4 visit and later documented a promoter-run event with about 150 patrons that ran into the early morning hours. Staff said the property is in a zoning district that does not allow an extended‑hours (EHP) permit; the city attorney sent written notice to the property owner citing public‑nuisance and unpermitted after‑hours activity. Staff advised the venue must submit updated ownership paperwork and may require a minor amendment or administrative follow-up to bring records into compliance.

Northern Ducks (1355 Market Street) was reported for alleged after‑2 a.m. events; inspectors set a new sound limit after equipment changes and provided operator education. The Brixton (2140 Union Street) received a citation for exceeding its sound limit on March 4; Mays and McTeegs received notices of violation after inspections measured levels above approved limits or found entertainment operating beyond permitted hours. For Halcyon, staff reviewed time‑stamped surveillance and concluded the discrepancy was negligible (music appeared to end at about 4:00:50 a.m. and the venue cleared by 4:03 a.m.); Director Wylen did not issue formal action but scheduled a follow-up to confirm the venue clock and warned that further violations could trigger progressive discipline.

Commissioners pressed staff on follow-up options. They asked whether denial of entry to inspectors had been investigated (staff said inspectors identified themselves with city credentials and were denied entry in at least one instance) and suggested bringing problematic permit holders back before the commission or agendizing permit amendments that would allow the commission to place conditions on permits. Azevedo said administrative amendments and hearings are tools staff can use and that many violations are addressed through citations, NOVs and written notices from the city attorney.

The commission did not take additional regulatory action at the meeting beyond the cited enforcement steps but asked staff to continue monitoring the listed venues and to report back if noncompliance continues.
