Madison County approves maintenance-bond resolution after debate over excluding cracked portico slab

Madison County board members voted to approve a resolution concerning the courthouse renovation's maintenance bond after a brief debate over exclusion language that some members said would omit the south portico's top vertical slab from warranty coverage.

Speaker 1 challenged language in the draft resolution, saying the paperwork appeared to exclude "the top vertical top slab" of the south portico even though the slab already shows a quarter-inch crack. "I don't think we should exclude the south vertical top slab. It already has a quarter inch crack in it," Speaker 1 said, urging the board not to accept language that would shift existing defects outside warranty coverage.

Speaker 1 also said Erin, the county attorney, had expressed concern that the design team might not be vigorously advocating for the county's interests, a caution the board noted. "The concern that she has is whether the design team is sufficiently advocating for the county's interest," Speaker 1 summarized, citing the county attorney's advice.

After brief discussion and a request for clarification on the exclusion language, the chair requested a motion to approve. A motion was made and seconded; the resolution passed by voice vote after one member registered opposition. Speaker 3 noted the board had discussed the project for months and was ready to move forward unless additional numbers or facts arose.

The board did not provide additional amendments to the resolution on the floor and instructed staff to record the vote in the meeting minutes and proceed with the next administrative steps associated with the maintenance bond and project closeout.
