Doctor Jay read legal guidance received from counsel, referencing Arizona statutes and the terms of ESA agreements, and said that many superintendents he contacted were not allowing ESA students to participate because of funding and regulatory questions. He cautioned that one ESA contract provision appeared to require that parents not file a homeschool affidavit under ARS rules if they accept ESA funds.
A public commenter, Renee Johnson, described the affidavit process from the homeschool perspective and said parents often withdraw a homeschool affidavit when they accept ESA funds and contract for services. Board members asked for clarification from the state superintendent's office and the Arizona Interscholastic Association (AIA) on the distinctions between ESA recipients, homeschool affidavits, and participation rules for athletics and clubs.
Some board members urged exploring ways to accept ESA students — for example, charging higher non‑enrolled athletic fees — to both collect fees and introduce families to district offerings; others emphasized potential funding shortfalls for athletics if large numbers of non‑enrolled students participate. Doctor Jay said staff will contact the state superintendent and relevant association counsel and return with legal precedent and options before the board considers a policy change.
