The St. Joseph Planning Commission approved a conditional‑use permit to allow used‑vehicle sales at 701 South Eighth Street, with a specific condition that gravel areas on the property not be used for parking or vehicle display unless those areas are brought up to code.
Brandon, planning staff, explained that vehicle sales are conditionally permitted in the applicable commercial zoning and recommended approval with the gravel restriction. "They're not required to remove the gravel. They're just not allowed to park anything on it," Brandon said, adding that continued violations could result in permit revocation and loss of business license.
During public comment, resident Daniel Paltz of 713 Locust Street said he has observed cars on the site and told the commission, "I approve it," also stating, "I've seen him selling cars there already." Commissioners asked staff about enforcement; Brandon said typical zoning compliance tools — drive‑bys, warning letters and, ultimately, permit revocation — would be used for persistent violations.
The commission moved, seconded and approved the conditional‑use permit. The approval allows Cornelius Auto Sales, LLC (represented at application time by Sean Polacek) to operate used‑vehicle sales at the address so long as the property complies with the gravel‑parking restriction and any other applicable code requirements.
Next steps for the applicant include any construction or site work that would require separate permits and code inspections; staff will monitor compliance and pursue enforcement if the property is used in violation of the condition.
