Commissioner (Speaker 1) opened a work session to solicit department-head input on a draft Utah County standards-of-conduct policy that had been circulated this week. The draft prompted concern from several department chiefs and elected department heads that parts of the proposed policy overlap or conflict with state law and that some provisions (for example, sanctions or concepts like 'insubordination') do not fit the legal status of elected officials.
Anthony Canto, county surveyor, told the commission the draft contains conflicting language and urged staying within state code. "I would rather see the elected officials code say something along the lines of 'as authorized by law,'" he said, adding that creating county policy that extends beyond state code could render enforcement vulnerable to legal challenge.
Sheriff Mike Smith and county recorder Andrea Allen echoed concerns about enforceability and redundancy with state law. HR director Ralph Barnes said the draft had grown beyond its original intent as HR-focused guidance and favored splitting the work: adopt an employee-facing standard soon and consider a separate approach for elected officials.
After extended discussion, commissioners generally agreed on a bifurcated approach: move forward promptly with Option 2 (a standards-of-conduct document that applies to employees and non-elected county staff) with all references to elected officials removed, and ask the civil division and HR to redraft the employee policy, circulate it to department heads and to four incoming elected officials, and return a cleaner document for commission action before year end. Commissioners also discussed whether appointed department heads should be treated with employee-focused protections given their lesser job security.
Public comment from resident Emily Peterson urged simple cross-references to state code and clearer public-facing guidance about where to find relevant rules. The chair said the commission will strike references to elected officials for the employee policy and expects a revised proposal from civil and HR.
