Utah County commissioners strike agenda item on leaked document after closed-session review; public seeks more transparency

Following a closed-session review at their meeting, Utah County commissioners moved to return to regular session, bring agenda item 27 back for consideration and then struck the item from the agenda after concluding the document at issue had been in non-county circulation since 2020.

A motion to bring item 27 back was made, seconded and approved "3–0" by the commissioners. After reporting their review, a commissioner said the matter did not warrant county action because the document had been circulating publicly for more than two years: "It's not a leakable matter when it's been out in the public realm for at least 2 years," the commissioner stated. The commissioners then moved to strike agenda item 27; the motion passed by the same unanimous count.

Members of the public pushed for more transparency. Sylvia Andrew asked why the commission was not proceeding with the item and said voters "want to know what is going on between the attorney's office and the sheriff's office." Carol Ferguson thanked a commissioner for submitting the item for review under what she described as authority in "Utah Code," and urged a thorough, public investigation if warranted.

Commissioners and staff responded that the item before them had a narrow scope related to a specific document and that a separate ongoing criminal or administrative investigation referenced by the public lies outside the commission's direct role. One commissioner said the three of them operate as separate public officials and can only confer on county business in public meetings or closed sessions with legal counsel when appropriate.

The commission also took several procedural agenda actions during the meeting: it agreed to continue item 7 for two weeks (to June 29), struck items 29–31 from the agenda, and recessed into a closed session as planned. The meeting concluded with a unanimous motion to adjourn.

Next steps: Commissioners said they will remain open to new information and to pursue further action "if something does come up" that warrants investigation or a formal response.
