The Yellowstone County Board of Commissioners on Feb. 14, 2023 approved Resolution 23-19 to create Rural Special Improvement District (RSID) 884M to fund maintenance of portions of Central Avenue and Homewood Park Drive, but the board agreed to exclude a single parcel after a written protest from a nearby landowner.
Mike Black, the county's senior civil engineer, told commissioners that the RSID is a condition of subdivision approval for the West Meadow second filing and that notices were mailed to 63 property owners. "Before you today is a resolution to create a maintenance district for portions of 2 roads, Homewood Park Drive and Central Avenue," Black said. He described the parcels affected and the road segments that would provide a second access into the subdivision.
Black said the proposed assessment is "$45 per parcel per year. That's $22.5 for each of the May and November assessments." He said the assessments are anticipated to begin in November 2023 and that the district could be expanded in the future if large parcels are subdivided.
Resident JC Fortier, identified as living at 9 South Homewood Park Drive, registered the lone written protest and explained on the record that the parcel's driveway access and existing gates mean the property owner does not plan to use an entrance onto Central Avenue. "Once the fence is fully finished, there will not be access off Central," Fortier said, asking not to be included in the district because their driveway accesses South Homewood Park Drive.
Commissioners discussed options for handling the protester’s parcel. Black outlined three possibilities: keep the parcel in the district and assess it in perpetuity; exclude the parcel and keep the assessment at $45 with one fewer parcel; or redistribute the assessment among remaining parcels (he cited a hypothetical increase to $46.50 per parcel). The commissioners then moved to adopt Resolution 23-19 with an exception to exclude the referenced parcel (described in the record as Parcel T 4 A). The motion was seconded and approved by voice vote. The motion carried.
Next steps noted by staff include beginning assessments in November 2023 and annual review of the district and rates at future meetings. Black also cautioned that if the excluded parcel is later subdivided, the county would have the authority to expand the district at that time.
Votes and procedural record: the motion to adopt Resolution 23-19 with the stated exclusion was moved by a commissioner recorded as Speaker 3, seconded, and approved by a voice vote of the commission.
