Court remands Tamarac zoning denial; BZA instructed to file specific findings by Jan. 6, 2026

County staff informed the Marshall County Board of Zoning Appeals on Nov. 18 that a court issued a ruling on Nov. 6 regarding Tamarac’s zoning challenge: the court declined to overturn the BZA’s denial but remanded the case, ordering the BZA to enter specific written findings of fact explaining its denial and to file those findings with the court within 60 days.

Staff read the court conclusion into the record and said the BZA’s previously filed findings ‘‘do not provide a specific factual basis for BZA’s determinations’’ and therefore the court has remanded the matter. The county’s deadline to supply the required findings to the court is Jan. 6, 2026.

County counsel Derek Jones and staff will meet to determine who should prepare the new findings and whether current membership or earlier members should be named in the supplemental finding. The board agreed to schedule an executive session and a special December meeting to prepare the necessary documentation and comply with the court’s order.

Staff characterized the procedural outcome as favorable to the county insofar as the court did not overturn the BZA denial, but emphasized the need to produce more detailed findings to satisfy the court’s remand instruction.
