Treasurer‑Tax Collector Patrick Sullivan presented amendments to Lake County Code on Nov. 18 that would add enforcement mechanisms and due‑process language to the county’s cannabis cultivation tax ordinance. Sullivan said the new sections mirror collection tools used for transient occupancy and unsecured taxes — the ability to place liens, levy bank accounts and garnish wages — and that clarifying language would make the cultivation tax apply to medical, commercial and recreational cultivation activity.
Board members raised concerns that a draft apportionment provision could be construed to expand the cultivation tax’s scope or result in double taxation for state microbusiness licensees that perform cultivation plus other activities. County Counsel and the treasurer proposed removing the apportionment text from the ordinance and instead handling apportionment through administrative procedures under the existing cannabis business tax ordinance if needed. The board approved first reading of the ordinance as amended and voted to advance the draft to the Dec. 9 meeting for possible adoption (motions and voice votes recorded).
