The Selma City Council voted Nov. 4 to restrict remote appearances in closed sessions and to bar Councilman Juan Trujillo and Interim City Manager Kunkel from joining the upcoming closed session remotely.
City Attorney Costanzo told the council he had received reports of “a series of disclosures of both confidential documents that were submitted to you in closed session” and “at least 1 occasion on which the entirety of the closed session was broadcast over the live stream,” and said the council should adopt a short written resolution that would prohibit remote closed‑session appearances unless a majority of the council votes to allow them.
The council first voted to add Costanzo’s proposed resolution to the open‑session agenda. The clerk recorded a roll call with Mayor Robertson, Mayor Pro Tem Guerra, Council member Avalos and Council member Oseguera voting yes; the motion to add the item carried.
After discussion, council members voted on a motion to prohibit remote access to the forthcoming closed session for Councilman Trujillo and Interim City Manager Kunkel; the clerk recorded a roll call with Robertson, Guerra, Avalos and Oseguera voting yes and the motion carried. The council also approved language instructing that, going forward, no one may appear remotely in closed session without prior majority approval of the council.
Costanzo said he would prepare the written resolution after the meeting and that the mayor would be authorized to sign it if the council approved the final draft. He also recommended holding closed sessions in the council’s back room temporarily, saying, “we've also gotten reports that people can hear us when we're in here outside.”
No members of the public addressed the council during oral communications. The council then convened to closed session to discuss four items announced in open session: pending litigation (City of Selma v. Fernando Santeon, FCST temp number 21396081); a liability claim by Fernando Santeon (claim presented 10/09/2025); public employment under Government Code §54957 regarding non‑safety contract employees and possible non‑salary enhancements; and one potential litigation matter under Government Code §54956.9.
The council did not disclose any closed‑session deliberations or outcomes in the public record at the time the meeting went into closed session.
