A proposal to rezone a single property at 65 Beach Street/East Brockway Avenue from R‑1A (single‑family residential) to R‑2 (single and two‑family residential) was forwarded to the council agenda after staff and planning commission review.
Development Services director Ricky Jaeger explained the property previously had a multi‑family use for about two decades but lost its grandfathered legal nonconforming status after the structure was vacant for more than one year. The owner applied for a map amendment; staff said rezoning to R‑2 would allow the property to pursue a conditional‑use permit with the Board of Zoning Appeals to reestablish a three‑unit dwelling if approved.
Jaeger said staff’s review and an on‑the‑ground survey suggested there are several other similar preexisting nonconforming properties in the immediate area and that the neighborhood may be a candidate for broader upzoning consideration in the future. Planning commission recommended forwarding the amendment to council for consideration and the Committee of the Whole agreed to add the ordinance to a future agenda.
