Commission adopts updated subdivision ordinance to meet state deadline; makes administrative changes

San Juan County commissioners voted unanimously to adopt an updated subdivision ordinance that replaces the county’s existing subdivision rules for unincorporated areas.

County planning staff and the planning commission advanced the revised Chapter 6 to the commission after an expedited review prompted by state legislation. Planning staff said the revision implements provisions required by recent state law and is intended to streamline approvals for small subdivisions.

Planning staff described the key change as administrative approval for many small subdivisions: “it was mandated that, this becomes an administrative process…designates, myself or whoever's in my position as a planning administrator to be the approving body for both your preliminary and the final,” a staff member said. Under the adopted ordinance, subdivisions of fewer than 10 lots may be approved administratively by the planning administrator with review by a plat review committee (health, roads, surveyors, attorney, recorder) rather than through a full commission hearing.

Staff also said the ordinance clarifies appeals: amendments added that appeals may be accepted from “adversely affected property owners,” not only applicants. Commissioners acknowledged the quick timeline forced by the state bill and reserved the right to revisit and amend the ordinance after implementation.

The motion to adopt the ordinance was made by Commissioner Adams, seconded by Commissioner Stubbs, and passed 3–0.
