Representative Heather Scott, speaking to the House State Affairs Committee, introduced RS31836, titled "Memorial Defining Marriage," and asked the committee to schedule a full hearing on the measure. "The purpose of this resolution is just to reaffirm our state authority to regulate marriage. That should be a job of the state, not of our courts," Representative Heather Scott said.
Scott told the committee the 2015 U.S. Supreme Court decision in Obergefell v. Hodges was a 5–4 ruling that, she said, "effectively nullified marriage laws" in many states. Scott said the four dissenting justices agreed the court had exceeded its constitutional authority and that the decision undermined state sovereignty and the democratic process. She described the resolution as a request that the Supreme Court revisit Obergefell and called for the issue to be returned to the states.
