The commission addressed a long-running enforcement matter involving unpermitted structures and resource-area impacts at 10 and 16 Ocean Avenue. Commissioners and staff said the original enforcement action led to a notice of intent that has been continued multiple times and that the violations identified in the initial enforcement action remain unresolved.
The commission discussed enforcement alternatives — including amending the enforcement order, issuing a new enforcement order, financial penalties and referral to state DEP strike teams — and noted that the notice-of-intent process is preferable when it produces a timely resolution but can be stalled by repeated continuances.
By recorded vote, the commission amended the enforcement order to require the violator or their representative to attend the Conservation Commission meeting on Nov. 6, 2025 and provide an update on steps taken to resolve the violations. Commissioners said the enforcement order remains an active document while violations persist and that additional enforcement steps will be considered if the appearance or update is not satisfactory.
Commissioners tasked staff to notify the respondent and pursue other enforcement tools if the required attendance or remedy does not occur.
