Missoula County commissioners approved a subdivision-exemption application to create a utility lot near the Miller Creek gravel pit to be conveyed to the City of Missoula for municipal water.
County staff member Michael Tester presented the application and said the exemption is being used under Montana Code Annotated 76-3-2011(h), which allows creation of right-of-way or utility sites. Tester said the new parcel would be adjacent to an existing water tank and described it as approximately 100 by 50 feet (about one-third of an acre). He said the county already obtained a signed utility statement from the city and that signing the affidavit and the landowner's agreement included with the application will be required.
A commissioner moved and seconded to sign the subdivision-exemption application and associated affidavit; the board approved the item by voice vote when the chair asked, "All in favor? Aye."
Tester said any subsequent changes to the lot will be subject to the requirements of the subdivision chapter. The board did not identify additional conditions at the meeting.
