Committee discusses telehealth recording and AI use; seeks clearer scope and testimony on H.84

The Health Care committee revisited telehealth recording and the use of artificial intelligence in medical records during its May 9 meeting, noting earlier walkthroughs and preliminary testimony on H.84.

Members recalled prior testimony about hospitals’ interest in recording telehealth encounters for AI purposes and asked for a focused hearing on permission, consent and the intended downstream uses of recordings. One member noted hospitals asked to delay the bill this year and preferred testimony next year; others said a short‑term hearing could clarify recording consent and the interplay with AI tools.

The committee discussed narrow approaches such as clarifying when recordings require patient permission, what safeguards apply to AI‑derived outputs and whether recordings used for training or clinical decision support need distinct privacy protections. Staff were asked to check prior testimony and ascertain whether additional witnesses (hospitals, patient advocates and privacy experts) could present during interim work.

No policy was adopted at the meeting; members requested follow‑up testimony and documentation of prior hearings on H.84.
