The Hilliard Board of Zoning Appeals approved a variance to reduce pool and decking setbacks at a Sugar Run Drive property, voting unanimously to allow the rear setback to drop from 10 feet to 5 feet and the west-side setback from 10 feet to 8 feet.
Staff presented the site plan to the board and said the pool and decking were outside a five-foot storm easement along the rear property line and that the proposed reductions were “not a significant variance” that would “not alter the character of the neighborhood.” The board’s motion incorporated the two conditions recommended in the staff report.
Applicant Jamal Zbchiewicz of Aqua Pools Construction told the board the construction will respect the five-foot storm easement and will not affect grading. “We would be keeping the 5 foot storm easement, and we would not affect the grading,” Zbchiewicz said. He also confirmed the pool will have an automatic cover.
The formal motion approved language referencing Hilliard code section 1 1 2 1.06 f 4 c to reduce the minimum setback from the rear property line from 10 feet to 5 feet and from 10 feet to 8 feet for the west side of the property for a pool and adjacent walks, and it incorporated the two staff recommendations into the approval.
Vote tally recorded on the record: Mister Epling — yes; Mister McGee — yes; Vice President Barfield — yes; Mister Steele — yes; President Deisel — yes; Mister Antle — yes; Mister Mills — yes. The chair announced the motion carried 7–0.
The board did not add additional conditions beyond those in the staff report. No members of the public offered objections on the record, and the applicant thanked the board for consideration.
