Commission approves partial vacation of utility easements at Magnolia Reserve townhomes

The City Commission approved a resolution vacating the front 34 feet of a five-foot utility easement on several lots within the Magnolia Reserve Townhome subdivision after staff said the request came from the developer to accommodate walkways and partial columns that were omitted from initial plans.

Staff explained the vacation request applies to multiple lots (presented in the record as "Lots 112132425363748") and described the easement as a five-foot side-yard easement for which the developer sought a partial vacation of the front 34 feet running from the front to the rear of the properties. Staff said the final plat recorded in May 2024 showed the easements; the developer'9s site work during permitting revealed walkways and column features within those easements that are not allowed under current standards.

Per standard practice, staff sent notice to utility providers; the city reported no objections from utilities. The commission read the resolution into the record and voted to approve the partial vacation; the transcript records the motion carried unanimously with Commissioner Kennedy absent.

Staff said they recommended approval and will record the resolution and necessary documents with Orange County public records as required by the resolution.
