The Punta Gorda Code Enforcement Board found on May 28 that the property at 2817 Sancho Panza Court violated Punta Gorda Code chapter 26, section 8.11 (roof/property maintenance) and chapter 9, section 9.2(g) (public nuisance related to pool enclosure screens) and ordered the respondents to bring the property into compliance within 15 days.
Co‑compliance supervisor Nick Faulkner presented 17 photographs and described inspections starting January 30, 2025 that found a roof in disrepair and a pool enclosure with torn or missing screens that he characterized as "detrimental to the public safety and welfare." Notices were sent by certified mail; the most recent notice was returned undelivered and staff posted a notice on the property and at City Hall Annex.
The board found the city had established a prima facie case and then voted to issue a cease‑and‑desist order and require compliance within 15 days from receipt of the order. The board assessed $20.98 in case costs, due within 15 days, and warned the respondents that failure to comply could result in fines up to $250 per day plus interest. Building staff told the board the building department will determine whether a permit is required to repair or replace the roof; screen replacement for the enclosure does not require a permit.
The board discussed temporary measures and confirmed that merely installing a temporary barrier that blocks the pool would not constitute compliance; replacement of the enclosure screening is required.
