DeBary council approves second reading of DeBary Town Park MPUD minor amendment

The City of DeBary City Council on a unanimous vote approved the second reading of Ordinance O2-2025, a minor amendment to the DeBary Town Park mixed planned unit development, after the council elected to import the record from the May 21 quasi‑judicial hearing.

The council’s action came after the city attorney outlined the ordinance text and recommended, with council consent, that the record from the prior hearing be incorporated so participants would not need to restate earlier testimony. City Clerk swore in potential witnesses and the council heard no public participation on the item.

The ordinance, as read into the record, amends a development agreement previously approved by Ordinance 12-2022 and amended by Ordinance O9-2023 for DeBary Town Park, a multiuse project encompassing roughly 32.17 acres on the west side of US 1792, identified by Volusia County tax parcel numbers 90401230010 and 90400000040. The city attorney noted the amendment provides for severability, conflict resolution, and an effective date.

Council members asked no substantive questions at the second reading. After a motion to approve the second reading and a second, votes were recorded: Council member Sowell — yes; Vice Mayor Butlin — yes; Council member Papalardo — yes; Council member Stevenson — yes; Mayor Karen Chazet — yes. The ordinance passed on second reading with no public rebuttal or additional testimony.

The council moved on to subsequent agenda items following the vote.
