The Whitefish Community Development Board on July 17 recommended approval of text amendments to the city subdivision regulations to reflect recently passed state legislation and to clarify local procedures for parkland dedication and subdivider contributions.
Planner Wendy explained the amendments implement three bills from the most recent state legislative session: Senate Bill 553 (clarifies a subdivider may contribute a combination of land and cash for parkland), House Bill 233 (establishes a process by which a homeowners association can petition the city council to revert dedicated parkland back to the HOA), and House Bill 714 (clarifying language for subdivision exemptions). Wendy said staff added an explicit definition of “homeowners association” to the subdivision code so the reversion process is administrable at the local level.
Wendy noted staff consulted with the parks director about the process for reverting parkland and that the city’s changes primarily mirror state law. The packet included an exhibit (Exhibit A) with underlined changes; staff apologized that track‑change formatting did not convert perfectly in the PDF. There was no public comment at the hearing.
A motion to recommend approval of the text amendments passed unanimously. Wendy said the amendments also correct a few editorial items (for example, replacing references to the planning board with the Community Development Board where appropriate).
