Commissioners amend settlement to redirect developer distributions to Richard Baron Builders

The Board of Lorain County Commissioners approved an amendment to a settlement agreement originally adopted in 2022 that affects distributions tied to a Redfern Road sanitary sewer and pump station development agreement.

Staff told commissioners the original agreement provided for tap-in fee distributions to the developers who built the associated infrastructure. Because a named recipient, Timothy ("Mister") Carney, recently passed away, the amendment redirects future distributions to Richard Baron, Builders and Developments Company, Inc., at the request of the developers.

"As part of an early ... development agreement for the Redfern Road sanitary sewer and pump station, we collect tap-in fees from the new homes that tap into the sanitary sewer," the county engineer's office noted. "The original agreement had the payments dispersed back to the developers ... we're amending it to send those checks as requested by the developers to Mr. Barron."

Commissioners approved the amendment on a recorded voice vote with all commissioners present voting aye.

Less critical details: the settlement traces to resolutions adopted in 2022, and staff said the change responds to developer requests and the recent death of the previously named payee.
