Commission approves 15-foot easement for utility pole relocation behind SoMa Commons

The Elkhart Redevelopment Commission on July 8 approved the form and content of an easement for utility pole relocation behind the Hug Street development that adjoins the SoMa Commons park.

Staff said AEP (or Indiana Michigan Power, as referenced) requires a 15-foot easement to relocate poles and that the easement would allow poles to be moved to reduce the slope between SoMa Commons and the adjacent parking lot for the development.

A motion to approve the easement form and attached exhibits passed by voice vote with ayes recorded and no recorded opposition. Staff said the easement would enable the utility to shift poles and still leave adequate room in the park and slope area; specific construction timing and coordination were not detailed at the meeting.

The action was an approval of easement documents; it does not itself convey property until recorded under the terms of the approved easement and exhibits.
