Commission hears update: temporary restraining order halts community garden development

At a Red Bluff Parks and Recreation Advisory Commission meeting, staff reported that litigation has put a proposed community garden project on hold.

A staff member said a temporary restraining order (TRO) issued in June prevents development or construction on the property at issue and that a later hearing extended that restriction. The staff member did not provide a court case number or the TRO text at the meeting.

The staff update named three parties involved in the litigation as recorded in the meeting: Council Member Strokes, We Are The Village and 1 Seed At A Time. The staff member said they do not know when the dispute will be resolved.

The staff member told commissioners that whoever controls the property after the litigation is resolved would still be required to obtain a use permit from Red Bluff’s planning commission before developing a community garden. “Ultimately, whoever controls the property will...be required to receive a use permit from the city's planning commission for the development of the garden,” the staff member said.

Commissioners asked for the update during staff reports; there was no formal action by the commission on the garden at the meeting.
