The Lincoln County Board of Commissioners on Aug. 6 approved an order legalizing portions of North 3 Rocks Road (County Road No. 1) and Savage Road (County Road No. 11), a step county staff said is required to validate right-of-way for a federal bridge replacement project at Crowley Creek.
Michael DeJuan, county public works director, said the legalization follows a public hearing held at a previous meeting. He told the board staff received limited public contact after the hearing and that no objections or claims under the cited statute were filed. "We did not have any testimony of objections or claims under 3 68 2 11," DeJuan said.
DeJuan said the county submitted survey work by the county surveyor, identified in the record as Adam, and that validating the right-of-way is necessary because the project will use federal funds. "As part of that process, because we're using federal funds, we're required to validate the right of way," he said.
The board directed county counsel to prepare the draft order; the chair read the draft order during the meeting and the board approved the legalization on voice vote. The chair stated the order will be signed that day.
Why it matters: Legalizing the road segments is an administrative step to ensure the county can show clear right-of-way before proceeding with federally funded bridge replacement work at Crowley Creek.
Next steps: County counsel will finalize and the board signed the order; public works staff indicated the legalization is intended to clear a path for right-of-way validation that is a prerequisite for the federal bridge project.
