Joint body accepts withdrawal of conditional use permit appeal for CUP 2510

At a joint meeting of the Minnehaha County Commission and the Sioux Falls City Council, officials accepted the petitioner’s request to withdraw an appeal of Conditional Use Permit (CUP) 2510.

The withdrawal concerned an appeal of the Joint Planning Commission’s denial to transfer building eligibility from Lots 2 and 3, Lacey’s Second Addition North Half, to Lot B of Lacey’s Tract 2 North Half in Section 35, T102N R49W, Mapleton Township. County planning staff told the bodies the petitioner submitted a written request to withdraw the application.

County Commissioner moved to accept the withdrawal and the county roll call recorded the motion as carried. The council then moved to withdraw the item from its agenda; a roll call vote in the Sioux Falls City Council recorded unanimous approval, 7-0.

No further testimony or debate was recorded on this item during the joint meeting. The withdrawal ends the joint body’s review of CUP 2510 without a substantive decision on the merits of the permit.
