The Planning and Development Board on Aug. 24 voted unanimously to recommend that the Board of County Commissioners adopt an ordinance amending Flagler County's subdivision regulations to bring the code into compliance with Florida Senate Bill 784, which makes plat approvals administrative and reduces legislative review of certain plat actions.
Staff said the amendments remove references requiring board or commission action for planning steps that state law now treats as administrative. Staff also recommended removing the rarely used "sketch plat" process and clarified that waivers of subdivision requirements (for example, requests to exceed cul‑de‑sac length limits) remain a board-level decision.
Growth Management staff cautioned that the ordinance is one part of a larger land‑development code update and said the county is adjusting other elements in response to recent state legislation, including Senate Bill 180. The staff presentation noted the transmitted comprehensive-plan update was paused after Department of Commerce review flagged provisions that state staff said could be interpreted as more burdensome than state law allows; staff said it will work with state reviewers to resubmit the plan after removing the affected provisions.
After a brief public-comment period with no speakers, the board moved, seconded and voted to recommend the subdivision-regulation amendments to the Board of County Commissioners. The ordinance will be transmitted to the commission for formal consideration.
