Why it matters: The after‑the‑fact order required removal or mitigation of pavement placed near the brook and a restoration planting plan for the 25‑foot riverfront buffer. The order included a condition that restoration be completed within one calendar year; the agent said the deadline has passed and the commission did not have an update from the property owner.
Agent Kyle said he had sent a follow‑up letter requesting the owner attend the Aug. 20 meeting and provide a progress update, but no one appeared. He said his next steps are to meet with the city law department, arrange a site visit and decide enforcement next steps. Kyle noted that the commission requires a preconstruction meeting and agent oversight for permitted work and said he has not received evidence that a preconstruction meeting occurred for this site since the order was issued.
Next steps: Kyle will confer with the law department, attempt to reestablish contact with the property owner and arrange a site inspection. Depending on the findings, the commission could pursue enforcement, require required plantings or other corrective actions, or issue penalties per the enforcement procedures in the commission’s order.
