BZA approves 280‑sq‑ft shed variance for Delmar Street property

On Aug. 6, 2025, the Town of Saint John Board of Zoning Appeals voted 3‑0 to grant a developmental variance allowing a single 280‑square‑foot accessory structure at 10117 Delmar Street. The board determined the application met the findings required under STJMC 24‑461.

Applicants John and Diane Kicker told the board they were purchasing a lofted shed and presented photos of the property. Planning staff explained the town’s ordinance permits a maximum of 160 square feet for one accessory building and 250 square feet total between multiple accessory buildings; "Maximum altogether is 250 square feet, but it has to be separated between 2 buildings," the staff member said. The Kickers requested a single 280‑square‑foot building rather than two smaller buildings under the ordinance split.

No remonstrance letters or public opposition were received. The board’s motion to approve recited the required findings of fact and passed 3‑0. The variance permits the Kickers to build the single 280‑square‑foot structure instead of complying with the split‑building requirement.
