The Fort Myers City Council on Oct. 20 voted against authorizing a letter of intent to lease the city-owned Hall of 50 States building at 2254 Edwards Drive, stopping the city manager from moving ahead with negotiations with a prospective lessee.
Supporters of other proposals, including longtime applicant Jim Becker, had urged the council to allow wider participation in the process. Jim Becker, who said he has sought the site for years, warned the council that he had continued interest and experience operating cultural and recording venues downtown. "I've been doing this for 48 years ... the Hall 50 States, I'm gonna make it what originally was, a venue for concerts and then also recording," Becker said during public comment.
The motion to authorize the city manager to sign a letter of intent with one prospective operator failed on a roll-call vote. The clerk recorded: Councilmember Bong yes; Councilmember Brown no; Councilmember Geraldo yes; Councilmember Watson no; Councilmember Bouschett no; Councilmember Burson no; Mayor Kevin Anderson yes. The motion did not carry.
Why it matters: Council members and the public said the decision affects a long-empty, city-owned property and the downtown economy. Supporters of acting now said continued delay risks the building remaining vacant; opponents and some council members raised procurement and fairness concerns and noted the council previously solicited proposals and received multiple expressions of interest at different times.
What the council discussed: City Manager Marty Lawing told councilmembers staff had solicited unsolicited proposals after a formal RFP process that produced limited responses, and that two proposals remained active. Some councilmembers said negotiating further with a single party while other prospective operators (including Becker) were not in the current negotiation could invite legal protest under procurement rules. Public commenters Joe Madden, speaking for Hall of 50 States Enterprises, called the city's current approach "highly irregular" and asked that Becker be integrated into the process; city staff said the time windows for proposals and the manager's negotiations were set by prior direction from council and that restarting the process would require a new public solicitation.
What happened next: A later motion to move forward again with the manager's negotiations was made and failed; the council directed staff to schedule a work session on Oct. 27 to revisit the matter. Council members who argued for delay said they planned to meet with Becker and review whether the city should re-open the process publicly.
Provenance: The item was discussed under agenda item 7.19 (letter of intent to lease city-owned property at 2254 Edwards Drive). The transcript shows public comment in support from Jim Becker and a statement from Joe Madden representing Hall of 50 States Enterprises, staff remarks about the negotiation history, and the roll-call vote by the council.
