The finance administration committee on Sept. 18 recommended Borough Council approve Resolution 2025-19, which increases the borough's maximum reimbursement for a bridge project to account for additional contractor costs tied to revised insurance requirements. The committee voted to forward the resolution to council for final action.
The measure matters because Amtrak added insurance requirements after bids were issued, which the borough's staff said would have raised contractor costs substantially. "It amounted to something like $28,000,000 more in insurance that they had to carry, which would have resulted in increased cost of about $300,000 to the contractor," a staff member told the committee, adding Amtrak and the contractor later negotiated the insurance terms.
Staff explained the increased reimbursement request raises the allowable federal reimbursement so the borough and the contractor are not left covering added costs. "What this does though is that this increases then the cost of the total reimbursement that we are eligible for to account for the additional costs that are incurred as a result of the change in insurance requirements," a staff member said, noting without the change the borough would only be eligible for reimbursement up to the original amount. Committee members were told the additional reimbursement request represents millions that the borough does not currently have available.
Committee discussion: members asked clarifying questions about the negotiation and the risk that terms could change; staff said, "Amtrak has come to an agreement in terms of what the additional insurance requirements will be" and that, under the borough's reimbursement agreements, the increased amount should be covered by federal reimbursement. Staff cautioned that conditions could still change and promised to handle any future changes.
Action and next steps: the committee voted to recommend the resolution to council; council will consider final approval. If council approves, staff said the existing federal reimbursement agreement would be amended to reflect the higher maximum reimbursement tied to the project.
Context and background: the discussion grew out of a bridge contract that went out to bid earlier; Amtrak omitted a required fee schedule and additional insurance terms from the original bid package, creating a funding gap once the omission was discovered. The item was presented to the finance administration committee as a recommendation to council.
