ZBA approves second-floor addition; accessory-apartment permit must be maintained

The Town of Babylon Zoning Board of Appeals on Aug. 19 approved application 25129 by Lisa Moore, Alicia Hunt and Alfredo Hunt for a second-floor addition at 260 Linton Avenue in Lindenhurst, subject to three conditions placed on the approval.

Michael J. Degnan, the project's registered architect, told the board the proposed second floor would sit over the existing first floor without changing front, side or rear yard setbacks and would not alter lot coverage. Degnan said the existing accessory apartment — where Ms. Moore currently resides — will remain and that he expects she will continue to live there under a renewed accessory-apartment permit. "She expects to continue to live and enjoy the Second Floor under the accessory use apartment," Degnan said.

The board approved the application with conditions recorded on the face of the certificate of occupancy: the front porch and portico must remain open, internal access through the dwelling must be maintained, and the accessory-apartment permit must be renewed and maintained if a unit remains on the property. A motion to approve application 25-129 with those three conditions passed without further public comment.

The town's planning-division and environmental-control memos were entered into the record; the board did not enumerate additional modifications at the hearing.
