The Kettering Planning Commission on July 7 approved a record plan (case PC-25-6) that realigns lot lines between properties at 550 and 598 West David Parkway after construction at 550 West David Parkway partly encroached onto the neighboring parcel.
City Planner Ryan Holmesy described the request as “a fairly straightforward request,” saying the replat was meant to “rectify at least that lot line issue” after work at 550 West David Parkway was unintentionally located partly on the neighboring property. Holmesy told the commission the proposed lot layout meets minimum lot size, frontage and setback requirements and that the surveyor must certify (seal) the final plat.
The commission’s action approves a final record plan that covers 5.483 acres and creates two lots: one measuring 4.402 acres and one measuring 1.081 acres. Holmesy noted multiple existing easements that cross the properties and said staff asked the surveyor to show the locations of those easements on immediately adjoining properties; an earlier draft did not show the full extent of an existing drainage and access easement.
Jordan Staley, speaking for property owner John Berry Jr., said the replat “clearly resolved the issue by aligning the property lines to the actual site conditions,” that no variances are required and that the applicants agreed with staff recommendations and conditions.
The planning department recommended approval with two conditions: 1) the applicant must coordinate with and adhere to any recommended changes from the city of Kettering, Montgomery County or other utility reviewers (the opportunity to recommend changes will sunset two weeks after planning commission approval), and 2) the plat drawing must be sealed by the surveyor. The commission amended the motion on the record to correct an address error in the resolution text (the record was corrected from 595 to 598 West David Parkway) before voting.
Carol Fisher, the commission secretary, read the formal motion and the commission voted unanimously to approve the record plan as amended: Fisher — yes; Ray Waskey — yes; Don Rathman — yes; Ken Lackey — yes; Troy Urbis — yes. Following the vote, staff indicated the signed plan could be returned to the planning office for recording once the conditions are met.
Separately, the commission approved the minutes of its June 2, 2025 meeting. The roll call on the minutes recorded votes of Fisher — yes; Don Rathman — yes; Ray Waskey — yes; Ken Lackey — yes; Troy Urbis — abstain; the motion carried.
At the end of the meeting, Holmesy told the commission that the next meeting will include a public hearing on a pending zoning code amendment and that the first round of public comment on the comprehensive plan closed June 30. No members of the public spoke during the audience-participation period.
The planning commission’s approval is final at the commission level but, as Holmesy reminded attendees, actions of the planning commission can be appealed to the Kettering City Council.
