Commission recommends approval for Dunlap second-dwelling conditional use after long enforcement history

On Oct. 8 the Albany County Planning & Zoning Commission recommended approval of a conditional use permit (CU-04-25) that would allow a second dwelling on a rural residential property at 39 Peakview Road (Wild Horse Ranch).

Planning staff said the property is 38.85 acres and that the applicant had an open enforcement case for having multiple principal structures on acreage that does not meet allowed density. Staff reported the parcel’s current ownership cooperated with the county; a prior enforcement action from 2019 had not been resolved under the previous owner.

Staff recommended approval after county reviews, including input from Wyoming Game and Fish (which suggested wildlife-friendly fencing). The commission discussed wording in the staff report that said the applicant "is in compliance"; planning staff committed to clarifying phrasing so the record reflected that approval of the conditional use would bring the property into compliance.

Applicant Lance Dunlap said he and the new landowner are working through the permitting steps and thanked staff for guidance. Commissioners voted to recommend approval; the county board later recorded an abstention from one member and the remainder voted to approve the recommendation.

The action will advance to the Board of County Commissioners for final approval of the conditional use permit CU-04-25.
