San Francisco Commission scrutinizes Gestalt management for repeated permit violations

The San Francisco Entertainment Commission convened recently to address ongoing permit violations at Gestalt, a local business located at 3159 Sixteenth Street. This meeting marked the second appearance of owner Daniel Hawkins before the commission, following a series of complaints and citations related to noise and operating hours.

Since April 2021, the commission has received a staggering 79 sound complaints against Gestalt, with 61 of these occurring after the business was granted its Live Performance Permit (LLP) in July 2021. The establishment has been found in violation of its permit conditions 12 times during inspections, leading to two Notices of Violation (NOVs) and six citations. The most recent citations were issued for operating entertainment past the permitted end time of 11 PM, with incidents recorded at 12 AM and 2:30 AM.

During the meeting, Sean Saber, the current manager of Gestalt, expressed his commitment to addressing these issues. Saber, who has been managing the establishment for about a year, attributed past violations to previous staff members and emphasized plans for significant operational changes, including a strict code of conduct for employees. He stated, “These are not suggestions; these will be cold, hard rules.”

Commissioners raised concerns about the management structure and accountability, questioning how violations could occur under Saber’s watch. They highlighted the importance of adhering to permit conditions, especially as Saber is in negotiations to purchase the business from Hawkins. The commission discussed the potential implications of ongoing violations on the business's future, particularly regarding its ABC license, which is crucial for its operations.
