San Francisco juvenile hall remains open despite planned closure and legal complexities

San Francisco's efforts to close its juvenile hall, initially set for December 31, 2021, have faced significant setbacks, leaving the facility still operational three years later. The Board of Supervisors had introduced legislation in 2019 aimed at closing the hall and expanding community-based alternatives for youth detention. However, a recent meeting revealed that the Board never formally approved the necessary proposals, resulting in a lack of obligation to implement the recommended changes.

During a meeting with Chief Miller of the Juvenile Justice Center, commissioners learned that the recommendations from a comprehensive 2021 report, which included 39 suggestions for programs and activities, were never legally vetted. This oversight has contributed to ongoing confusion about the future of juvenile hall. Currently, the facility, designed for 150 beds, houses only 22 youth, highlighting the disconnect between capacity and actual need.

Additionally, recent state legislation, including Governor Newsom's SB 92, mandates that California maintain open juvenile justice facilities, complicating San Francisco's goal of eliminating youth incarceration. As a result, the city is legally required to keep juvenile hall operational, despite the intention to shift towards rehabilitative, non-institutional alternatives.

The lack of a formal plan for the facility's future means that no physical changes can be made, leaving the community in a state of uncertainty. Moving forward, stakeholders will need to navigate these legal and logistical challenges to align San Francisco's juvenile justice system with its rehabilitative goals.
