Falmouth Zoning Board approves special permit for 130-foot monopole by Vertex Towers

The Falmouth Zoning Board of Appeals convened on November 7, 2024, to discuss a significant proposal from Vertex Towers LLC, which seeks a special permit and variance to construct a 130-foot monopole for wireless communications at 737 Gifford Street. This location, currently used for outdoor self-storage, is situated in an Agricultural Business (AGB) zoning district, where structures exceeding 50 feet require special approval.

The proposed monopole aims to address coverage gaps for Verizon Wireless, which has identified the area as critical for improving service, particularly around high-traffic locations such as the nearby high school. The board noted that the Cape Cod Commission had previously approved the project, determining that its benefits outweighed potential detriments.

During the meeting, Vertex's attorney, Francis Parisian, emphasized the necessity of the tower, citing increasing demand for telecommunications services, especially as more residents rely solely on wireless technology. He argued that the proposed site is uniquely positioned to meet these needs due to its size and existing infrastructure, including a power line easement that minimizes visual impact.

Concerns were raised by board members and the public regarding the monopole's height and potential health implications from radio frequency emissions. However, Parisian clarified that the Federal Communications Commission (FCC) regulates these emissions, and the proposed facility would operate well within safety limits.

The board discussed the procedural aspects of granting the special permit and variance, noting that while federal law limits local authority to deny such projects, the board still has the responsibility to ensure compliance with local zoning laws. Ultimately, the board voted to approve both the special permit and the variance, citing the project's alignment with community needs and existing zoning regulations.
