City Council Faces Legal Challenges in High-Stakes Lawsuit

During a recent government meeting, key discussions centered around legal representation requests and a revenue contract amendment.

The meeting opened with a request for legal representation and indemnification for three city officials—Assistant Director Lori Sowell, Field Operations Manager Carl McClanahan, and Field Supervisor Piper Williams Faulkner—related to the lawsuit of Tatiana Louise Billings versus the City of Detroit (Case No. 23-006345-CD). Graham Anderson from the Law Department reported that while a case evaluation did not yield a resolution, a settlement conference is scheduled for the upcoming Monday, which he believes may lead to a resolution. Anderson requested a two-week postponement for further discussion on the matter, allowing time to assess the outcome of the settlement conference.

Council members expressed their support for Anderson's request, with one member commending his responsiveness and dedication. The motion to revisit the legal representation requests in two weeks was unanimously approved.

The meeting then transitioned to new business, discussing a revenue contract amendment with Linebarger, Goggin, Blair and Sampson LLP. This amendment extends the contract period for the Department of Appeals and Hearings until June 30, 2025. Julianne Pastula, the director of the department, clarified that the contract amount remains at zero, as the vendor's fees are contingent upon the amounts collected from unpaid judgments. These fees range from 10% to 30%, depending on the age of the judgments and whether garnishment actions are filed.

The discussions highlighted the city's ongoing legal challenges and its efforts to manage revenue collection effectively, reflecting the complexities of municipal governance and legal affairs.
