In a recent city council meeting, the council addressed an appeal from JE Taylor of White Dove Investment Corporation regarding a nuisance abatement decision affecting the property at 5310 South Peoria, Tulsa, Oklahoma. The council is tasked with determining whether to uphold, deny, or modify the previous ruling that deemed the property a public nuisance.
Devin Lucas, the neighborhood abatement coordinator, presented a detailed history of the property, highlighting ongoing violations dating back to August 2018. The issues began with complaints about skate ramps and other zoning violations, leading to multiple citations issued to the property owner over the years. Despite numerous attempts to achieve compliance, including several rounds of notices and citations, the owner has failed to rectify the violations, which include excessive signage and unauthorized outdoor entertainment facilities.
Lucas noted that the situation escalated to the point where police intervention was necessary due to the uncooperative behavior of the staff during inspections. The owner eventually pleaded guilty to some violations in 2021 but has since ceased communication with city officials, prompting the need for further action.
The council clarified that public comments would not be taken during the appeal hearing, a new rule aimed at streamlining the process. The outcome of this appeal could set a precedent for how similar nuisance cases are handled in the future, as the council weighs the evidence presented by code enforcement against the appellant's arguments.
