California Bill Aims to Combat Deepfake Pornography Exploitation

In a recent government meeting, California lawmakers discussed two significant bills aimed at addressing emerging social issues related to technology and public safety.

The first bill, AB 1856, seeks to criminalize the creation and distribution of deepfake pornography without the consent of the individuals depicted. Assemblymember Todd highlighted the alarming rise of deepfake technology, which has been increasingly used to create realistic but fabricated sexual content, often targeting women. Mark Berkman, CEO of the Organization for Social Media Safety, emphasized the urgent need for this legislation, citing a staggering increase in deepfake pornography from just one known instance in 2016 to over 143,000 uploads in the first three quarters of 2023. Supporters argue that the bill is essential to protect individuals from harassment and exploitation, while opponents, including the ACLU, raised concerns about potential First Amendment violations and the disproportionate impact on youth.

The second bill, AB 3064, aims to enhance firearm safety by requiring manufacturers of firearm safety devices to label their products with make and model information. Assemblymember Mainshine explained that this measure would help consumers identify recalled or defective devices, thereby improving safety. Deputy Attorney General Candace Chung supported the bill, noting that many existing devices lack identifying markings, making it difficult for consumers and law enforcement to ensure their effectiveness. However, opposition from gun rights advocates argued that the bill could unfairly penalize lawful gun owners and create unnecessary burdens.

Additionally, Assemblymember Ramos introduced AB 2138, a pilot project granting peace officer status to qualified tribal officers to address the crisis of missing and murdered Indigenous persons. This initiative aims to improve law enforcement responses on tribal lands, which have historically been neglected under public law 280.

As these bills progress, they reflect California's ongoing efforts to adapt to technological advancements and enhance public safety while navigating complex legal and social implications.
