During a recent meeting of the Zoning Board of Appeals (ZBA) in Riverwoods, significant discussions centered around a variation request for a side yard setback at 1965 Saunders Road. The petitioners, Jerry and Barbara McCulloch, are seeking approval to reduce the minimum required side yard setback from 40 feet to 20 feet to facilitate the construction of a three-car detached garage.
Director Witt presented the case, highlighting the challenges posed by the property’s existing conditions. The McCullochs' lot is classified as legal nonconforming, with dimensions that limit construction options. The property is situated within a regulatory floodway, further complicating potential building plans. The existing house already encroaches on the required side yard setbacks, leaving minimal space for the proposed garage.
Architect Olga Borofsky, representing the McCullochs, elaborated on the difficulties they face. She noted that adhering to the current setback requirements would restrict the buildable area to just 21 feet, which is insufficient for a standard garage. Borofsky emphasized that placing the garage in the center of the lot would obstruct views from both the house and the street, prompting the request to shift the garage further south on the property.
The ZBA acknowledged the petitioners' concerns and the unique circumstances of the property. The board is expected to review the information presented and make a recommendation to the village board regarding the setback variation. The outcome of this request could set a precedent for similar cases in the area, as the board navigates the balance between zoning regulations and property owners' needs.
