City approves $2 million settlement in excessive force case

In a recent government meeting, the City Council of Tulsa approved significant financial settlements related to two lawsuits against the city, totaling $2.175 million.

The first resolution authorizes a payment of $175,000 to Oscar James Brooks III, who filed a lawsuit against the city and Officer Josh Comfort for excessive force, malicious prosecution, and wrongful arrest. While the city was granted summary judgment on most claims, the excessive force claim proceeded to settlement. City Attorney Hayes Martin confirmed that the settlement was reached after a conference with the plaintiff's counsel and was approved by both the mayor and the council. The payment will be made from the city's sinking fund, which currently holds a cash balance of $68 million.

The second resolution involves a payment of $2 million to Diana Lunsford, stemming from a separate case against the city. This settlement, which exceeds $1 million, had previously been approved by the council and the mayor. The court has now ordered a judgment in favor of Lunsford, prompting the council to authorize the payment from the sinking fund as well.

Both resolutions included emergency clauses to expedite the payments, ensuring that the city meets its financial obligations promptly. The council's swift action reflects its commitment to resolving legal disputes and managing the city's finances effectively.
