City Council Approves Controversial Deck and Fence Project

During a recent city council meeting in Akron, members unanimously approved an ordinance allowing for a conditional use to construct a deck and solid fence at 1869 Daniels Avenue. The decision, which passed with a 10-0 vote, follows a favorable recommendation from the planning staff and planning commission.

The proposal, presented by David and Diana Farrell, seeks to vary the required 25-foot rear yard area by enclosing a pool with an attached deck that will extend to within 4 feet of the rear property line. The request exceeds the Board of Zoning Appeals' jurisdiction due to the significant variance it entails. Additionally, a 6-foot solid fence is planned to be constructed close to the Daniels Avenue right of way.

The council noted that the property’s unique topography, characterized by hilly terrain, creates a hardship for the homeowners. The proposed improvements are expected to enhance the property without negatively impacting neighboring residences. Traffic engineers have indicated that the fence's placement poses no safety concerns for pedestrians or vehicles.

The public hearing segment of the meeting included support from community members, including a local preacher who expressed willingness to assist the Farrells in their endeavor. A contractor representing Weatherseal Home Services also spoke in favor of the project, indicating strong community backing for the proposed changes.

The council has scheduled a follow-up public hearing for July 22, 2024, to further discuss the ordinance and gather additional public input.
