City moves forward with controversial development agreement

During a recent city commission meeting, officials discussed a significant development agreement between the city of Atascadero and property owner Scott Newton concerning a 4-acre site located at Viejo Camino and El Camino Real. This agreement comes after previous attempts to develop the site for mini storage were denied by the city council, leading to litigation that resulted in a settlement requiring the city to process a new development agreement.

The proposed agreement outlines potential uses for the property, allowing for the development of up to 42 residential units. However, no formal development plan has been submitted at this time. The agreement is binding for ten years and will require a general plan amendment to align with the city’s ongoing general plan update, which is expected to permit residential use on the site.

Additionally, the agreement includes provisions for the potential realignment of an ephemeral creek that currently runs through the property. The property owner aims to modify the creek to enhance the developable area, although any changes must comply with local, state, and federal regulations regarding hydrology and flooding.

The commission's discussions highlighted the importance of this agreement in providing clarity and certainty for future development on the site, as well as the need for adherence to environmental standards during any proposed modifications.
