City Board Considers Controversial Signage Variance for Union Square

During a recent government meeting, officials discussed a variance development standard request concerning the Union Square project at 170 Jersey Street. The proposal includes four key modifications to the sign standards outlined in the Unified Development Ordinance (UDO).

The requests are as follows:

1. Allow temporary banner signs exceeding 32 square feet until a certificate of occupancy is issued.
2. Permit projecting signs larger than 16 square feet that extend more than 18 inches from the building facade.
3. Approve an electronic wall sign specifically for parking details.
4. Allow signage on top of awnings over tenant spaces.

The meeting was properly noticed, and no public comments were received regarding the variance. Curtis Saddison, representing Old Town Companies, was present to address any questions. He highlighted the need for temporary signage during the leasing phase prior to construction completion, particularly at four designated locations featuring chimney stacks. Saddison noted that these banners could also serve to promote city and park events, not solely for the project.

However, the discussion revealed concerns from city officials regarding the first amendment implications of regulating the content of the banners. The department expressed caution about granting a blanket variance that could lead to complications in content regulation. The board was encouraged to consider conditions for approval, particularly for the temporary banner request, to ensure compliance with legal standards.
