City Commission Approves Controversial Property Rezoning Plan

In a recent planning commission meeting, a motion was passed to approve a request for rezoning properties located at 1644, 1648, 1652, and 1656 Deckner Avenue, along with 129, 133, 137, and 145 Oak Grove Avenue, from a general commercial district to an office residential district. The motion, made by Vice Chair Miller and seconded by Commissioner Lutzow, received a majority vote of 5 in favor and 1 against, and will now proceed to the city council for consideration on November 12.

The rezoning request was initiated by property owners Dennis and Cindy Scherer, who are seeking to sell their home located at 129 Oak Grove Avenue. The current zoning classification has posed challenges for potential buyers in securing financing, as the property is classified as a legal nonconforming use within the commercial district. This classification prevents the construction of new single-family homes and complicates rebuilding efforts in the event of damage.

City staff presented that the proposed office residential district would allow for single-family homes with a conditional use permit, thus providing a pathway for the Scherers and other affected homeowners to align their properties with zoning regulations. The commission emphasized the importance of addressing the broader implications of the rezoning, as it impacts multiple properties in the area, not just the Scherers' home.
