At the Oct. 1 meeting the board received an administrative briefing on recent state changes to critical-area variance standards and on membership and court-case updates.
Staff and counsel explained two principal changes the board will begin applying to variance applications filed after the effective date: applicants must demonstrate a substantial need for the variance that is not merely convenience, personal preference or financial advantage; and applicants must demonstrate that the development cannot be located outside the habitat protection area (a stricter "cannot locate elsewhere" test). Ron Marnie, land-management division chief, told the board these changes "are deliberately intended to tighten up variances in general" and that counties will need to provide more detailed findings in orders. Counsel Lisa Sanders recommended tightening factual findings and said training materials and a recorded training will be circulated.
Staff also announced membership changes approved by the Board of County Commissioners (Ron Scott moved from alternate to full member; Barbara Warner appointed member; Miriam Gold appointed second alternate) and noted the Lehi/Lasby Villas matter will go to Circuit Court on Oct. 8. The board discussed how the new rules affect the criteria and emphasized that applicants and staff will need to provide more detailed evidence and that the BOA will tighten orders accordingly.
