The Alpharetta Planning Commission approved text amendments to the Unified Development Code on Oct. 1 that add definitions for "business vehicle" and "recreational vehicle," revise where such vehicles may be parked in residential districts, and create a clear variance pathway for neighbors to support exceptions.
Staff (Kathy Cook) said the amendments respond to recent code-enforcement cases and a court ruling that highlighted a gap in definitions. The new definitions exclude government vehicles and allow a business vehicle with carrying capacity under 1.5 tons (including vehicles used for home occupations) to be parked on a paved driveway. The changes also permit a variance process requiring signed affidavits of support from contiguous property owners who would see the parked vehicle.
Cook told the commission the changes were intended to give homeowners a route to seek relief (for example, to legally keep a small trailer used for a motorcycle) and to clarify enforcement. Commissioners noted that homeowner-association bylaws can be stricter than city code and therefore continue to control in many neighborhoods. A motion to adopt the UDC text amendments as presented by staff passed unanimously.
