The City Council considered a request from Mojo's Good Vibes LLC to grant an exception from the local prohibition on alcohol sales within 300 feet of a public or private school or daycare. Planning staff reviewed the governing provisions of the Texas Alcoholic Beverage Code and explained municipal waiver paths, including obtaining a letter of non‑opposition from the affected user or a council waiver request.
Neighbors and public commenters, including Marco Sanchez and representatives of Paso Del Norte Children’s Development Center, argued the location is too close to schools and daycares and raised concerns about parking, trash and community safety. The property owner and building owner told council a prior 51% alcohol establishment had operated for more than a decade with minimal record of police interaction.
Council suspended the rules to allow additional public comment, heard from the property owner and multiple members of the public, and then voted on a motion to grant the exception. The motion failed 3–5; the meeting transcript records votes in favor by Representatives Rocha, Piero and Canales and nays from Chavez, Acevedo, Nino and Limon (the transcript lists the vote roll call on the record). The failure means the 300‑foot prohibition remains in place for that location.
