The Planning & Zoning Commission continued a rezoning request from 4C Land Trust (case 2610077ZC) to the Oct. 26 meeting after staff and legal counsel raised issues about a previously proffered developer's agreement that the county and applicant had negotiated as part of an earlier approval.
Kenneth Odom told the board that the prior rezoning and developer's agreement condition the range of allowable uses on the parcels; staff recommended denial of a B5 rezoning for a lower parcel because M2/intensive uses are not what the original developer’s agreement contemplated. Odom also reported the site's lack of immediate utilities and flagged an on‑site portable sawmill the county is investigating as a potential zoning/code violation; code enforcement has opened a file and staff said the operator has indicated plans to remove equipment.
Applicant Randall Ellevort said the developer's agreement had been signed and delivered to county counsel and stressed the owners’ willingness to proffer land for future utility expansion and to cooperate. County counsel and staff cautioned the commission that until the developer's agreement status is confirmed and any contradictory elements are addressed, the public notice and the application package may not fully reflect the dynamics at issue. To allow time for coordination and possible amendment, the commission unanimously moved to continue the rezoning to Oct. 26.
